5. Pricing and Fee Agreement
Our standard pricing is 50% of the total first-year property tax savings realized as a result of a successful protest. This fee structure is disclosed on our Website and reiterated during client intake.
You will be required to sign a formal Agency Agreement before we proceed with filing a protest on your behalf. This agreement will contain:
- Specific terms regarding compensation
- Scope of services
- Authorization to act as your agent before the county assessor or valuation board
We do not bill unless savings are achieved through a formal reduction in taxable value.
6. No Guarantee of Results
We do not and cannot guarantee any specific outcome. You acknowledge and agree that:
- Property valuations are at the sole discretion of your county assessor or valuation board.
- NM Property Tax Protest makes no guarantees, warranties, or representations as to your chances of success.
7. Errors, Omissions, and Limitation of Liability
While we strive to provide accurate, timely, and thorough services, you acknowledge and agree that NM Property Tax Protest shall not be held liable for any error, omission, missed deadline, miscommunication, technical malfunction, or clerical mistake, including, but not limited to:
- Failing to file a protest on time
- Submitting incorrect or incomplete information
- Overlooking applicable evidence or documentation
To the fullest extent permitted by law:
- You expressly waive any and all claims for damages, direct or indirect, resulting from such errors or omissions.
- Our maximum liability for any claim shall not exceed the lesser of (i) fees you actually paid to us in the six (6) months prior to the incident, or (ii) $500.
You agree that your sole remedy in any such case is to discontinue using our services.
8. Ownership and Use of Content
All content on our website, including but not limited to text, graphics, logos, designs, and documentation, is owned by or licensed to NM Property Tax Protest and protected by copyright, trademark, and other laws.

13. Injunctive Relief
You acknowledge that a breach of these Terms may cause irreparable harm to NM Property Tax Protest, and that monetary damages may be inadequate. We shall be entitled to injunctive relief to enforce these Terms without the need to post bond or prove damages.
14. Dispute Resolution and Arbitration
Any dispute arising out of or relating to these Terms or our Services shall be resolved through binding individual arbitration in Bernalillo County, New Mexico, under the rules of the American Arbitration Association (AAA). You waive your right to a jury trial and class action.
The arbitrator shall have exclusive authority to resolve any disputes regarding this Agreement, including enforceability and arbitrability. Judgment may be entered in any court with jurisdiction.
If arbitration is deemed unenforceable for any reason, exclusive jurisdiction and venue shall lie in the state or federal courts located in Bernalillo County, New Mexico.
15. Force Majeure
We are not liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, government actions, power failures, and internet outages.
16. Changes to Terms
We may modify these Terms at any time. Updates will be posted on this page with an updated effective date. Continued use of the Website or Services after such changes constitutes your acceptance of the revised Terms.
17. Entire Agreement
